A reckless driving incident ultimately led to the arrest of an Equality man on a drug-related charge.
On June 2, Deputy Payton received a call regarding a reckless driver on Alabama Highway 9. He was provided a description of the vehicle, and upon coming in contact with it he observed the vehicle driving recklessly.
He conducted a traffic stop, and as he approached the vehicle he could smell alcohol. Payton conducted a field sobriety test to ensure that the driver was safe to operate a motor vehicle, and he saw signs of impairment in the process.
Additionally, Payton observed an open container when the driver got out of the vehicle. As such, he proceeded to conduct a search of the vehicle based on the open container seen inside.
That search resulted in Payton finding 4.22 grams of a green leafy substance, found to be marijuana, in a glass jar.
Kevin Mitchell McPheeters, 69 years old, was arrested and charged with second-degree possession of marijuana. His bond was set at $2,500, and he was released on bond June 3 to await trial.
