PROCLAMATION

BY THE GOVERNOR

 

WHEREAS the Alabama Legislature at its 2025 Regular Session enacted Act No. 2025-227 (SB118) and Act No. 2025-291 (HB354), proposing amendments to the Constitution of Alabama of 2022;

WHEREAS, in conformity with Section 284 of the Constitution of Alabama of 2022, as amended, the Legislature has ordered an election by the qualified electors of the state upon such proposed amendments; and

WHEREAS notice of this election, together with the proposed amendments, is required by law to be given by proclamation of the Governor, which shall be published once a week for at least four successive weeks immediately preceding the day appointed for the election;

NOW, THEREFORE, I, Kay Ivey, as Governor of the State of Alabama, do hereby give notice, direct, and proclaim that on Tuesday, May 19, 2026, an election will be held in the State of Alabama in the manner and form provided by law upon the following proposed amendments to the Constitution of 2022 of the State of Alabama:

AMENDMENT PROPOSED BY ACT NO. 2025-227

Section 16.

That all persons shall, before conviction, be bailable by sufficient sureties, unless charged with capital murder, as provided in Section 13A-5-40, Code of Alabama 1975, as amended; murder, as provided in Section 13A-6-2, Code of Alabama 1975, as amended, or any solicitation, attempt, or conspiracy to commit murder; kidnapping in the first degree, as provided in Section 13A-6-43, Code of Alabama 1975, as amended; rape in the first degree, as provided in Section 13A-6-61, Code of Alabama 1975, as amended; sodomy in the first degree, as provided in Section 13A-6-63, Code of Alabama 1975, as amended; sexual torture, as provided in Section 13A-6-65.1, Code of Alabama 1975, as amended; domestic violence in the first degree, as provided in Section 13A-6-130, Code of Alabama 1975, as amended; human trafficking in the first degree, as provided in Section 13A-6-152, Code of Alabama 1975, as amended; burglary in the first degree, as provided in Section 13A-7-5, Code of Alabama 1975, as amended; arson in the first degree, as provided in Section 13A-7-41, Code of Alabama 1975, as amended; robbery in the first degree, as provided in Section 13A-8-41, Code of Alabama 1975, as amended; terrorism, as provided in subdivision (b)(2) of Section 13A-10-152, Code of Alabama 1975, as amended; and aggravated child abuse, as provided in subsection (b) of Section 26-15-3.1, Code of Alabama 1975, as amended; and shooting or discharging a firearm, explosive, or other weapon into an occupied dwelling, building, railroad locomotive, railroad car, aircraft, automobile, truck, or watercraft, as provided in Section 13A-11-61(b); and that excessive bail shall not in any case be required.

Section 160.

(a) A district attorney for each judicial circuit shall be elected by the qualified electors of those counties in such the circuit. Such The district attorney shall be licensed to practice law in this state and shall, at the time of his or her election and during his or her continuance in office, shall reside in his or her circuit. His The term of office shall be for six years. and he He or she shall receive such compensation as provided by law; provided, the compensation shall not be diminished during his or her official term. Vacancies in the office of district attorney and in his or her staff shall be filled as provided by law.

(b) Clerks of the circuit courts shall be elected by the qualified electors in each county for a term of six years. If the office of register in chancery continues to be provided by law then the clerk of the circuit court may also fill such the office in a manner prescribed by law. Vacancies in the office of clerk of the circuit court shall be filled by the judge or judges of the circuit court who have jurisdiction over the county in which the office of clerk of the circuit court is located.

(c) Persons Individuals elected to the position of constable to assist the courts of the state as provided by law shall be subject to the same restrictions, rights, and limitations as are specified in section Section 280 of the Constitution of 1901 Alabama of 2022, and no law shall prohibit the receipt of fees for the performance of official duties of said the position while holding any other elected or appointed office.

(d) The revenue from fines, forfeitures, and court costs produced in district courts from the exercise of jurisdiction under municipal ordinances shall be apportioned between the municipality and the state as shall be provided by law.

FURTHER, I proclaim and direct that this proclamation shall be published once a week for the four successive weeks immediately preceding Tuesday, May 19, 2026, in every county as required by law.

OF THE TOWN OF KELLYTON, ALABAMA

Heretofore on May 7, 2026, a copy of Resolution No. 01-2026 adopted by the Town Kellyton, Coosa County, Alabama, and certified by the Mayor of the Town of Kellyton, was delivered to the Judge of Probate pursuant to Ala. Code §11-42-3 (1975), requesting an order
directing an election of annexation to be held in certain unincorporated areas on the border of the present corporate limits of the Town of Kellyton described as follows:

Commence at a 4” x 4” concrete monument in place being the Northeast corner of Section 24, Township 23 North, Range 20 East, Coosa County, Alabama, said point being the point of beginning. From this beginning point proceed South 01° 04’ 09” West along the East boundary of said Section 24 for a distance of 2206.38 feet to a point on the Northerly right- of-way of Washington Street; thence proceed North 60° 28’ 24” West along the Northerly right-of-way of said Washington Street to its point of intersection with the North right-of-way of U. S. 280 Highway; thence proceed Northwesterly along the Northerly right-of-way of said U. S. 280 Highway for a distance of 3304.98 feet to a point being the most Westerlypoint located on the North right-of-way of said U. S. Highway 280 of the KKB LL property
as shown and described by deed on record in the Office of the Judge of Probate of Coosa County, Alabama in Deed Book 828 at Pages 274-278; thence proceed North 08° 15’ 15” East for a distance of 199.11 feet to a point on the North boundary of the CSX Railroad right-

said South one-half of said Northwest one-fourth of the Northwest one-fourth for a distance of 1321.71 feet to a point on the West boundary of said quarter-quarter section, which is also the West boundary of said Section 13; thence proceed North 00° 56’ 42” West along the
West boundary of said quarter-quarter section and along the West boundary of said Section13 for a distance of 291.02 feet to its point of intersection with the Southerly right-of-way of Moon Road (Coosa County Road No. 46); thence proceed Northeasterly along the Southerly
right-of-way of said road for a distance of 2815.62 feet to its point of intersection with the centerline of Oaktasasi Branch; thence proceed Northerly and Northeasterly along the meandering centerline of said branch for a distance of 1827.94 feet to its point of intersection
with the West boundary of the Northwest one-fourth of the Southeast one-fourth of Section 12, Township 23 North, Range 20 East, Coosa County, Alabama; thence proceed North 00° 04’ 28” East along the West boundary of said quarter-quarter section for a distance of 32.0 feet to the Northwest corner of said Northwest one-fourth of the Southeast one-fourth of said Section 12; thence proceed South 89° 40’ 49” East along the North boundary of the Southeast one-fourth of said Section 12 for a distance of 2673.91 feet to the Northeast corner of the Northeast one-fourth of the Southeast one-fourth of said Section 12; thence proceed South 00° 19’ 22” East along the East boundary of said Southeast one-fourth, which is also the East boundary of said Section 12 for a distance of 2643.24 feet to the Southeast corner of
said Section 12 and said point also being the Northeast corner of said Section 13; thence proceed South 00° 10’ 31” West along the East boundary of said Section 13 for a distance of 5319.95 feet to the point of beginning.
The above described land is located in the Northeast one-fourth and the Northeast one-fourth of the Northwest one-fourth of Section 24; the South one-half of Section 12 and in Section13, Township 23 North, Range 20 East Coosa County, Alabama.
The map of the above-described area filed with the certified copy of Resolution No. 01- 2026 depicting the proposed boundary of the territory proposed to be brought within the limits of the Town of Kellyton, and that the territory is contiguous to the boundary of the Town of
Kellyton is available for viewing in the Coosa County Judge of Probate office between the hours of 9:00 a.m. and 3:00 p.m., any day the Courthouse is open for business.
For due cause shown, it is hereby ORDERED, ADJUDGED and DECREED that an election be held on Tuesday, June 9th, 2026, from 7:00 o’clock a.m. until 7:00 o’clock p.m. to determine whether a majority of the electors [as defined in Ala. Code §11-42-2 (1975)] residing
within the said territory are in favor of annexation. Pursuant to Ala. Code §11-42-2(4) (1975), each qualified voter who has resided within the boundaries of the territory proposed to be brought into the Town of Kellyton for three (3) months next preceding the election may vote at
said election. The election shall be conducted at the Kellyton Civic Complex, 145 Church Street, Kellyton, Alabama, 35089, a polling place within the limits of the territory proposed to be annexed.
IT IS FURTHER ORDERED by the Court that the Town of Kellyton appoint and notify Polling Officials and conduct the election as required by the Code of Alabama 1975, Title 11, Section 42; and Title 17, as applicable, at said polling place on election day, June 9th, 2026.
IT IS FURTHER ORDERED by the Court that absentee ballots be made available to those who qualify and that the deadline to apply for an absentee ballot is five (5) days before the annexation election set on June 9, 2026.
IT IS FURTHER ORDERED by the Court that notice of said election and of the date, time and place of holding same, shall be given by publication in the Coosa County News newspaper published in Coosa County, once a week, for three consecutive weeks preceding said election date and notice to be posted as appropriate in the Town of Kellyton.
IT IS FURTHER ORDERED by the Court that all expenses related to said election be borne by the Town of Kellyton.
As required by Ala. Code §11-42-2(2), the Court hereby declares that this Order of Election is entered and given pursuant to and under the provisions of Ala. Code §11-42-3 (1975).
